By creating an account, accessing, or using Doksa.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and NordAIConsult AS, Org.Nr. 936 175 953, Norway ("we", "us", "our"), the operator of Doksa.io.

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract, to create an account or use the Service.

What We Provide

We provide a technology platform that enables you to send research documents to third-party AI services for qualitative analysis. We provide the infrastructure, user interface, credit management, and result delivery.

What We Do NOT Provide

  • Research consulting or methodological advice
  • Guarantees of research validity or academic acceptance
  • Liability for AI-generated analysis results
  • Legal or ethical review of your research
  • Data protection compliance for your research (your responsibility)

⚠️ Important Service Limitation

The Service is a research assistant tool, not a replacement for your expertise as a researcher. All analysis outputs require your professional validation and interpretation.

Account Security

  • Maintain confidentiality of your login credentials
  • Notify us immediately of unauthorized access
  • You are responsible for all activity under your account

Acceptable Use

You agree NOT to:

  • Upload illegal, defamatory, or harmful content
  • Violate intellectual property rights of others
  • Attempt to access others' accounts or data
  • Reverse engineer, scrape, or extract our technology
  • Use the Service for automated/bulk processing beyond normal use
  • Resell or redistribute the Service without authorization
  • Upload malware, viruses, or malicious code

Academic Integrity

You are responsible for proper citation and disclosure of AI assistance in your research per your institution's policies and academic standards.

🚨 CRITICAL: Your Decision & Responsibility

You decide what documents to upload to our Service. By uploading any document, you are explicitly instructing us to transmit that content to our third-party AI service provider for processing.

You Are Solely Responsible For:

  • Obtaining necessary consent from research participants
  • Anonymizing or pseudonymizing sensitive data before upload
  • Compliance with GDPR, institutional ethics boards, and data protection laws
  • Ensuring you have legal right to upload and process the documents
  • Securing necessary research ethics approvals
  • Maintaining audit trails and data processing records

Our Role

We act as a technical intermediary. We:

  • Transmit your documents to our AI service provider per your instruction
  • Store analysis results in our EU-based infrastructure
  • Provide tools to manage and delete your data

AI Service Provider Processing

Our AI service provider acts as a data processor under GDPR Article 28. See our Privacy Policy for details on:

  • Data processing agreement terms
  • Log retention by our AI service provider
  • No use of your data for model training
  • Encryption and security measures

Credit System

  • You purchase credits to use the Service
  • Credits are consumed based on document length and analysis complexity
  • Subscription credits: Roll over with tier-specific caps (40-80%)
  • One-time purchase credits: Never expire
  • Credit cost estimates are indicative; actual usage may vary

Pricing & Billing

  • Prices displayed in EUR/USD and include applicable VAT where required
  • Subscription billing occurs on your billing anniversary (one month from sign-up)
  • Payments processed via Stripe; we do not store card details
  • Failed payments may result in service suspension

Cancellation & Refunds

Subscriptions:

  • Cancel anytime from your account settings
  • Cancellation takes effect at end of current billing period
  • Unused credits remain available until expiry per tier rollover rules
  • No pro-rata refunds for mid-month cancellations

One-Time Purchases:

  • Credits are final sale once processing begins
  • Refunds considered only for technical failures preventing use
  • Request refunds within 14 days to support@doksa.io

EU Consumer Right of Withdrawal

Under EU Directive 2011/83/EU, you have 14 days to withdraw from a purchase. However, by requesting immediate service performance (analysis processing), you acknowledge waiving this right for consumed credits. Unused credits may be refunded within the withdrawal period.

Your Content

  • You retain all rights to documents you upload
  • You grant us a limited license to process documents solely to provide the Service
  • Analysis outputs (codes, themes, visualizations) are yours to use
  • We do not claim ownership of your research or generated content

Our Platform

  • The Service, technology, algorithms, and interfaces are our intellectual property
  • You may not copy, modify, or reverse engineer our platform
  • Our trademarks and branding remain our property

⚖️ Maximum Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. No Warranty: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement.
  2. No Liability for AI Results: We are NOT liable for:
    • Accuracy, completeness, or validity of AI-generated analysis
    • Research outcomes, academic acceptance, or publication results
    • Methodological soundness of AI suggestions
    • Misinterpretation or misuse of analysis outputs
  3. No Liability for Data: We are NOT liable for:
    • Loss, corruption, or unauthorized access to your documents
    • GDPR violations or ethics breaches in your research
    • Data processing by third-party service providers
    • Your decision to upload sensitive or protected data
  4. Limitation of Damages: Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is less.
  5. Exclusion of Consequential Damages: We are NOT liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or research outcomes.
  6. Third-Party Services: We are not responsible for actions, errors, or policies of third-party services (AI service providers, Stripe, hosting providers).

Mandatory law: Nothing in these Terms excludes or limits our liability for fraud, gross negligence, willful misconduct, personal injury or death caused by negligence, or any other liability that cannot be excluded or limited under mandatory applicable law, including any mandatory consumer protection rights you may have in your country of residence.

Your Indemnification

You agree to indemnify and hold us harmless from any claims arising from: (a) your breach of these Terms, (b) your violation of laws or third-party rights, (c) your uploaded content, or (d) your research conduct or data handling.

By You

You may close your account at any time via account settings or by emailing support@doksa.io. Upon closure, your data will be deleted per our Privacy Policy retention schedule.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Fail to pay outstanding invoices
  • Pose a security risk or harm to the Service

We will provide reasonable notice except in cases of serious violations. Unused credits may be forfeited upon termination for cause.

Applicable Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

Please contact support@doksa.io first so we can try to resolve any issue informally before legal action.

If you are a consumer resident in Norway, you may also contact the Norwegian Consumer Authority (Forbrukertilsynet) or the Norwegian Consumer Council (Forbrukerrådet) for assistance with a dispute.

We may update these Terms to reflect changes in our Service or legal requirements. Material changes will be notified via email or prominent website notice at least 30 days before taking effect.

Continued use after changes constitutes acceptance. If you do not agree, discontinue use and close your account.
